Terms of service
1. Scope
These Terms of Service apply to purchases made through the Bruttus Meteorite online store and to contracts concluded between customers and:
Bruttus Ventures UG (haftungsbeschränkt)
Marienstrasse 23, 40212 Dusseldorf
Germany
Email: info@bruttusventures.com
Website: www.bruttusmeteorite.com
Bruttus Meteorite is operated by Bruttus Ventures UG (haftungsbeschränkt).
A consumer is any natural person who enters into a legal transaction primarily for purposes that cannot be attributed to their commercial or independent professional activity.
These Terms apply to the version available at the time an order is placed.
2. Products and Natural Materials
Bruttus Meteorite products are made using natural and individually varying materials.
Meteorite patterns, pearl surfaces, lustre, colour, shape, size, and other natural characteristics may vary from one piece to another. Product photographs represent the character and appearance of the materials but cannot guarantee an identical pattern or surface for every individual piece.
Such natural variations do not by themselves constitute a defect, provided that the delivered product conforms to the agreed characteristics, product description, and applicable legal requirements.
Where individual measurements or weights are described as approximate, minor variations resulting from the nature of the materials or the production process may occur.
3. Product Presentation and Contract Formation
The presentation of products in the online store does not constitute a legally binding offer. It is an invitation for the customer to submit an order.
The customer may place products in the shopping cart, review the contents of the cart, and correct or remove products before submitting the order.
By clicking the final button that clearly indicates an obligation to pay, the customer submits a binding offer to purchase the products shown in the order summary.
After the order is submitted, we send an electronic confirmation to the email address provided by the customer.
The purchase contract is concluded when we accept the order by sending an order confirmation by email.
The customer is responsible for providing a valid email address and ensuring that messages relating to the order can be received.
4. Order Process, Correction of Errors, and Contract Text
Before submitting an order, customers can identify and correct input errors using the functions provided in the shopping cart and checkout.
The customer can review the selected products, quantities, delivery information, and payment information before submitting the order.
We store information relating to the order in accordance with applicable legal and operational requirements.
The customer receives the relevant order details electronically after placing an order.
These Terms of Service can be accessed, saved, and printed from the website before an order is submitted.
Where customer accounts are available, certain order information may also remain accessible through the customer account.
The contract language is the language made available for the relevant checkout and contractual information at the time the order is placed.
We are not subject to any specific code of conduct unless expressly stated on the website.
5. Prices and Shipping Costs
The prices displayed in the online store include applicable German value added tax where required.
Shipping costs are charged separately unless expressly stated otherwise.
The applicable shipping cost is displayed before the customer submits the order.
For deliveries outside the European Union, additional import duties, taxes, customs charges, or handling fees may be imposed by the destination country. Unless expressly stated otherwise at checkout, such charges are the responsibility of the recipient.
Our Shipping Policy contains additional information regarding delivery destinations, estimated delivery times, and shipping procedures.
6. Payment
The payment methods currently available are displayed during checkout.
Only the payment methods actually shown to the customer during checkout are available for the relevant order.
Unless otherwise stated for a particular payment method, payment is due when the contract is concluded.
Payments may be processed by external payment service providers. Their own terms and privacy information may also apply to the processing of the payment.
The purchase contract for the products remains between the customer and Bruttus Ventures UG (haftungsbeschränkt).
7. Delivery
We deliver to the destinations made available during checkout.
We currently deliver to Germany, Switzerland, the United States, Australia, Hong Kong SAR and Singapore, subject to the applicable checkout options. Orders are sent together in one shipment. We do not offer split deliveries.
Any delivery restrictions are shown during the ordering process or in the Shipping Policy.
Estimated delivery and processing times are provided on the relevant product page, during checkout, or in the Shipping Policy.
Where a product is identified as a preorder product, customized product, or product with a specific production period, the stated estimated dispatch or delivery period applies.
Delivery times are estimates unless a specific binding delivery date has been expressly agreed.
Customers are responsible for providing a complete and accurate delivery address.
If delivery cannot be completed because the customer provided an incorrect or incomplete address, we may charge reasonable additional costs actually incurred where the customer is responsible for those costs under applicable law.
Founder Delivery
Founder Delivery is an optional premium delivery method available only for addresses in Germany. Your order is personally delivered by the founder of BRUTTUS. We contact you after purchase to arrange the delivery date. The charge is EUR 1,000 per order. The estimated delivery period is 3 to 5 business days, subject to the appointment agreed with you.
If you exercise a statutory right of withdrawal, we refund delivery costs only up to the cost of the cheapest standard delivery we offered for the same order. The additional cost of choosing Founder Delivery above that standard amount is not refunded. If standard delivery was free for your order, the entire EUR 1,000 Founder Delivery charge is an additional delivery cost and is not refunded following withdrawal. This does not limit your rights if we fail to provide the agreed delivery, cancel it ourselves, or if another mandatory legal right to reimbursement applies.
8. Transfer of Risk
For consumers, the risk of accidental loss or accidental deterioration of the goods passes to the consumer when the goods are delivered to the consumer or to a third party designated by the consumer who is not the carrier.
Different rules may apply where the consumer independently commissions a carrier that was not offered by us, in accordance with applicable law.
9. Retention of Title
The goods remain the property of Bruttus Ventures UG (haftungsbeschränkt) until payment has been made in full.
10. Right of Withdrawal
Consumers have a statutory right of withdrawal where the legal requirements are met.
Detailed information about the right of withdrawal, the withdrawal period, the effects of withdrawal, return costs, the model withdrawal form, and the electronic withdrawal function is provided in our:
Returns, Refunds and Right of Withdrawal Policy
The separate withdrawal information forms part of the information provided to consumers in connection with their purchase.
11. Defective Goods and Statutory Rights
Statutory rights concerning defective or nonconforming goods apply.
Where the legal requirements are met, customers may exercise the remedies available under applicable law.
The necessary costs of statutory remedy are borne in accordance with applicable law.
No additional commercial guarantee is provided unless such a guarantee is expressly stated for a specific product.
A manufacturer's guarantee or other separate guarantee, where one exists, does not restrict statutory rights.
12. Product Care and Customer Responsibility
Jewelry should be handled and cared for according to the care information supplied with the product or made available on the website.
Failure to follow care instructions does not remove statutory rights relating to defects that existed when risk passed to the customer.
Normal wear, accidental damage, misuse, improper storage, or damage caused after delivery are assessed separately from defects for which the seller is legally responsible.
13. Website Content and Intellectual Property
Unless otherwise stated, the content of the Bruttus Meteorite website, including brand elements, text, photographs, graphics, product designs, logos, videos, and other creative material, is owned by Bruttus Ventures UG (haftungsbeschränkt) or used with appropriate permission.
Website content may not be reproduced, distributed, commercially exploited, altered, or used to create derivative commercial material without prior permission, except where such use is permitted by law.
Access to the website does not transfer any intellectual property rights to the user.
14. Acceptable Use of the Website
Users must not intentionally interfere with the operation, security, or accessibility of the website.
The website must not be used to distribute malicious code, attempt unauthorized access, collect information unlawfully, impersonate another person, or engage in unlawful activity.
We may take reasonable technical measures to protect the website, customers, and business systems from misuse.
15. Liability
Liability is governed by the applicable statutory provisions.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not legally permitted.
Nothing in these Terms restricts statutory consumer rights.
16. Consumer Dispute Resolution
Bruttus Ventures UG (haftungsbeschränkt) is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
This does not prevent the parties from attempting to resolve a complaint directly.
17. Applicable Law
The law of the Federal Republic of Germany applies.
For consumers, this choice of law does not deprive the consumer of the protection provided by mandatory provisions of the law that would apply without this choice of law.
18. Changes to These Terms
We may update these Terms of Service where necessary.
Changes apply to future orders and do not retroactively change contracts already concluded unless the parties validly agree otherwise.
The version available at the time the relevant order is placed applies to that order.
19. Final Provisions
If an individual provision of these Terms is invalid or unenforceable, the applicable statutory rules apply.
The validity of the remaining provisions is not affected where legally permissible.
